1. Ownership of the website

The websites www.evuala.it and www.evuala.eu (hereinafter, the “Site”) are owned by STILOPAN S.A.S. DI GIACOBBE RAFFAELLA, with registered office in Avellino, Via Alvanella no. 7 and operational headquarters at 3 Taverna Campanile Street, part. Vat and tax no. 02305460640 and no. Avellino business register entry 149058.

2. Scope of application.

The offer of products and services on the Site is not intended for the private subject Consumer as outlined in Art. 3 of Legislative Decree. 206/2005 (Consumer Code) i.e. the natural person acting for purposes unrelated to the entrepreneurial, commercial, handicraft or professional activity carried out but is addressed only to individuals acting within the scope of their entrepreneurial, commercial, handicraft or professional activity (“Customer”).

3. Acceptance of the general conditions of sale

Products posted on this Site constitute the subject of an invitation to the Customer to place a purchase order (the “Order”).

The telematic submission of the Order by the Customer will imply full knowledge and acceptance of these general conditions so that the Company will not consider itself bound by conditions other than those under consideration, unless previously agreed in writing.

The Customer, before placing the Order must read, evaluate carefully and accept these general conditions, saving a copy once the online purchase procedure is completed.

4. Methods of purchase

The Customer may directly purchase the products and services in the electronic catalog published on the Site according to the descriptions, technical characteristics and prices indicated in the relevant information sheets.

Once payment has been received from the Customer, the Company will forward the order confirmation – containing all necessary information (Customer’s order number and date, billing information, recipient of the goods, price and related details) – to the address indicated by the Customer during registration, so that it will promptly initiate the steps related to the production and/or shipment of the goods.

The offer of the products listed on the Site is subject to the availability of raw materials; therefore, in the event of unavailability of one or more products or availability of the same in longer delivery times than those indicated in the information sheet, the aforementioned circumstances will be promptly communicated to the Customer, by telephone or e-mail.

Should the Customer need to request, prior to purchase, consultations or on-site inspections, customized quotations, even including conditions in addition to those indicated in the technical/information sheets of the various products or services in the catalog, said request will be handled outside this platform independently by the Company, with which the relevant rates will be agreed upon.

5. Expenses, time and mode of delivery

The delivery times of the goods indicated in the information sheets are purely indicative, therefore, a delay in shipment can under no circumstances justify claims for damages, contractual and/or extra-contractual liability, direct and indirect.

In order to ensure better logistical service and maximum security of the integrity of the purchased product, the goods will be available at the Company’s premises for pickup upon agreement regarding the manner and timing of the pickup. In this case, if the products are bulky, the Customer will have to equip himself with appropriate technologies and means for loading, handling and unloading the purchased products.

Among the services offered is also available delivery of the goods to the Customer’s premises and, in this case, the Customer will be aware of the shipping costs before the purchase. If the Customer decides to use this service, the goods will be delivered by national couriers. Any traffic restrictions and/or impediments to normal access to the asset delivery facilities should be reported in advance by the Customer to avoid delays or additional charges.

In addition, the Customer shall also take responsibility for verifying and measuring accesses and passages.

6. Selling prices

The prices shown on the Site are in euros, excluding VAT and include packaging costs in the standard type provided by the manufacturer(nylon, mille bubbles, cardboard on pallets, etc.).

Any and special packaging requirements (e.g., in a cage or other) are not included in the online purchase but may be quantified separately, with costs to be agreed upon at the time with the Company and at the Customer’s request.

In any case, the prices published on this site do not include placement and/or assembly and/or installation costs, which remain the responsibility of the Client.

7. Withdrawal

Legal withdrawal is a right that Leg. n. 206/2005 (Consumer Code) provides in favor of the consumer customer (i.e., the natural person acting for purposes unrelated to the entrepreneurial, commercial, craft or professional activity carried out) to whom is recognized, by law, the right of withdrawal or the right to reconsider about the stipulated transaction.

These regulations do not apply to professional clients i.e., those who purchase goods or services as part of their professional/business activity performed.

Therefore, since the offer of goods, products, and services advertised on this Site is intended only for professional customers (i.e., those acting for purposes related to their business, trade, craft, and professional activity), and not for consumer customers (acting for private purposes), it follows that the legal right of withdrawal regulations set forth in the Consumer Code do not apply.

8. Guarantees

The warranty is recognized for a period of 12 consecutive months from the making available of the purchased goods, as provided for persons acting within the scope of their business, trade, craft or profession.

The warranty is strictly limited to the free replacement of all original parts found to be defective as a result of material defects or defects in construction.

Warranty does not apply for failures resulting from assembly/installation or use not in accordance with the accompanying requirements, nor does it apply for lack of maintenance or misuse.

In any case, transportation, labor and replacement costs are the responsibility of the Customer.
